Dr Suresh Deman v Associated Newspapers Limited & Baroness Flather [2016] EWHC 2819 (QB)

The High Court has today struck out a defamation claim brought by the academic, Dr Suresh Deman, over a Daily Mail article which was originally published in November 2011 and which has since formed part of the newspaper’s online archive. Sir David Eady ruled that the claim was time-barred and that there was no reason to disapply the limitation period. In doing so, he confirmed that an attempt to bring proceedings for the rolling publication of online content after 1 January 2014 must be approached by reference to the single publication rule contained in s.8 Defamation Act 2013, irrespective of whether the article at the heart of the action pre-dates the commencement of the 2013 Act. The judgment therefore provides welcome clarification for online publishers who maintain historic archives.
